LingoSpeak Terms of Use (EULA)

1. Contract Scope
These Terms of Use (the “Terms”) are a legally binding agreement between you and LingoSpeak governing your access to and use of LingoSpeak applications, websites, and related services. By accessing or using the service, you agree to these Terms and the Privacy Policy.
In these Terms, “LingoSpeak,” “we,” “our,” and “us” means the operator of lingospeak.ai. “You” means the account holder or user of the service.

3. Eligibility, Registration, and Account Security
- You must be at least 13 years old, or older where local law requires a higher minimum age.
- You must provide accurate and current registration information and update it when needed.
- You are responsible for activities under your account and for maintaining account credential security.
- You must promptly notify us if you suspect unauthorized use of your account.
4. Service Description and Availability
LingoSpeak provides language-learning features that may include voice sessions, transcription, AI-generated coaching, and progress tracking. Feature sets may vary by platform, region, language, and entitlement state.
We may update features for reliability, legal compliance, product evolution, and security. We do not promise uninterrupted service or error-free operation.

Prices are shown in-app before purchase and may vary by storefront, taxes, jurisdiction, and Apple price tiers. Payment is charged to your Apple ID at confirmation of purchase.

6. Free Trials, Refunds, and App Store Rules
- Trial availability and duration, if offered, are disclosed in-app at the point of offer.
- App Store purchase billing and refunds are handled by Apple under Apple’s rules and policies.

- Uninstalling the app does not cancel subscription billing.
7. Account Deletion and Access Termination
You may initiate account deletion in-app from account settings. On deletion, we remove or de-identify account-linked data except where retention is required by law or for legitimate compliance, security, and dispute-resolution reasons.
Deleting your LingoSpeak account does not cancel App Store subscription billing. Cancellation must be done in Apple subscription settings.
8. Acceptable Use and Prohibited Conduct

9. User Content and License Grant
You retain ownership of content you submit, subject to rights needed to operate the service. You grant LingoSpeak a limited, non-exclusive, worldwide license to host, process, transmit, and display user content solely to provide, secure, and improve the service in accordance with our Privacy Policy.
10. AI Features and Output Limitations
The service uses automated and AI systems for transcription, dialogue generation, and speech synthesis. AI output may contain errors, omissions, or unexpected phrasing and should be independently evaluated before reliance.
LingoSpeak is provided for language-learning support and is not a substitute for legal, medical, financial, mental-health, or other regulated professional advice.
11. Intellectual Property and License to You
LingoSpeak and its software, designs, marks, and content are protected by intellectual-property laws. Except as expressly granted in these Terms, all rights are reserved.
Subject to your compliance, we grant a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the service for personal, non-commercial language learning.
12. Third-Party Services
LingoSpeak may rely on third-party providers such as app stores, cloud providers, identity providers, and AI services. Third-party services are governed by their own terms and policies.
13. Suspension and Termination by LingoSpeak
We may suspend or terminate service access where we reasonably determine misuse, fraud, legal exposure, material Terms violations, or security threats. Where practical, we may provide notice and remediation steps.
14. Warranty Disclaimer
To the maximum extent permitted by law, the service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
15. Limitation of Liability
To the maximum extent permitted by law, LingoSpeak and its affiliates, officers, employees, contractors, and licensors are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, goodwill, data, or business interruption.
Where limitations are restricted by law, liability is limited to the maximum extent legally permitted.
16. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless LingoSpeak from claims, losses, costs, and liabilities arising from your unlawful use of the service, your violation of these Terms, or your infringement of third-party rights.
17. Governing Law and Dispute Process
These Terms are governed by applicable law in the jurisdiction of LingoSpeak’s legal entity, subject to mandatory consumer protections that apply in your place of residence.
